This Agreement is between you and Geneius Health LLC (“Geneius,” “the Company,” “we,” “us,” or “our”).
- The Platforms: Includes toolboxgenomics.com, mygenestyle.com, and all affiliated subdomains.
- Genetic/Epigenetic Information: Data regarding your genotype and DNA methylation analysis generated by us or uploaded by you.
GENEIUS HEALTH IS NOT A MEDICAL PROVIDER.
- Our Services are for research, informational, and educational use only.
- Never change your medical behaviors based on our reports without consulting a physician. Reliance on any information provided by Geneius Health LLC and all affiliated domaines are solely at your own risk.
You agree that you will not use the Platforms or Services to:
- Forensic/Legal Use: Use any information received through the Services for forensic use, law enforcement purposes, or to attempt to identify other customers.
- Unauthorized Access: Use “scraping,” “crawling,” “spiders,” or automated software to extract data from our websites or servers.
- Commercial Exploitation: Resell, duplicate, or exploit any portion of the Services for commercial purposes without a separate written agreement.
- Harmful Content: Upload viruses, malware, or any material that is derogatory, defamatory, or constitutes harassment.
- Misrepresentation: Impersonate any person or entity, or misrepresent your affiliation with Geneius Health.
- Illegal Activity: Intentionally or unintentionally violate any local, state, or international laws.
Breach of Conduct: If you violate any of these provisions, Geneius Health reserves the right to suspend or terminate your account immediately and refuse all current or future use of the Services without a refund.
- Our Property: Geneius Health (or its licensors) owns all legal rights to the Services, software, and “Toolbox Marks.”
- Your Data: You retain ownership of your Genetic Information. You may request its deletion at any time.
- Waiver: You will not receive compensation for any commercial products developed by Geneius Health using de-identified, aggregate data.
- Indemnity: You agree to defend and hold Geneius Health LLC harmless from any claims arising from your breach of this agreement or your decision to share your data with third parties.
- Limitation: Geneius Health’s total liability shall not exceed the amount you paid for the specific service in question.
We offer a 30-day refund window. We will refund the cost of the report, less the cost of the physical kit and any credit card processing fees. Contact support@toolboxgenomics.com.
All disputes shall be governed by Utah law. You agree that any dispute will be resolved via binding arbitration through the American Arbitration Association (AAA) in Draper, UT. The losing party shall bear the costs of the arbitration and reasonable attorney fees.
